Spain's short-term rental licence rules vary by region, and they are tightening. In the Valencian Community, the VUT licence is tied to the owner — not the property. A new buyer cannot inherit it. They must apply from scratch, and in some municipalities, new licences are currently suspended. Operating without a valid licence exposes you to fines of up to €600,000 in some regions. Under the Horizontal Property Act amended in April 2025, a 3/5 vote by building owners can ban rentals regardless of what licence you hold. The keybox we used for late-night arrivals became prohibited in the Valencian Community from August 2024. A new 10-day maximum stay rule meant personally contacting guests with existing longer bookings to renegotiate individually. Then in July 2025, a national registration number became mandatory for all short-term rentals across Spain. Platforms removed non-compliant listings within 48 hours of the deadline. The property I am looking at already has a tourist licence. Does that mean I can operate immediately?
Not necessarily — and the answer depends on where in Spain the property is located. In the Valencian Community for example, the VUT tourist licence is registered to the owner, not the property. When the property changes hands, the licence does not carry over. A new owner has to apply from scratch. In other regions the rules differ. Separately, under Spain's Horizontal Property Act amended in April 2025, new operators across all regions now need explicit community approval before starting activity.
